Bankruptcy Questions

At the law firm of Gross & Patterson, LLC, in Pittsburgh, our lawyers spend a lot of time counseling our clients and explaining the U.S. Bankruptcy Code and how it applies to them. By explaining the law, we can help our clients understand the process they are going through.

Here are answers to the some of the questions our attorneys are often asked by people who want to learn more about filing bankruptcy:

  • How can I stop creditor harassment? The moment you file bankruptcy, creditor harassment must stop under federal law. If it doesn't, you may be able to sue the creditor.
  • Can I keep my car? The answer depends on how much your car is worth and whether you are making payments on it. We will do everything allowed under the Bankruptcy Code to protect your car if it is paid off and advise as to options you may have. You can also keep a car when there is a lien on the vehicle as long as you continue to make payments. We will also discuss the option of surrendering the car if it does not make financial sense to continue to make payments on the vehicle.
  • Can I keep my home? Pennsylvania allows you to keep home equity up to a certain amount. As long as you are current on your payments (or can get caught up), you can keep your home. If you are behind and can afford to catch up over the life of a Chapter 13 bankruptcy plan, you will be able to keep your home.
  • Can I stop home foreclosure? Filing bankruptcy will put an immediate stop to a home foreclosure and give you time to decide what to do.
  • What can I keep in bankruptcy? Bankruptcy exemptions allow you to protect many of your assets, including equity in your home, retirement assets and personal belongings up to a certain amount.
  • What are the pitfalls of debt consolidation? Unfortunately, debt consolidation does not stop interest and penalties from accruing on your debt. For most people, debt consolidation only results in greater debt.
