Bankruptcy Law Federal bankruptcy law enables individuals and businesses to either liquidate or reorganize their debts, provided that the individual or business meets criteria set forth in the Bankruptcy Code.  One purpose of bankruptcy law is to allow an individual to address debts and get a fresh start.

Chapter 7 Bankruptcy Generally, if you earn less than the state median income for your household size and your income is less than your monthly income, you may be able to file for Chapter 7 bankruptcy, which allows you to discharge most types of debts. Under bankruptcy law, only individuals can discharge debts.

Chapter 13 Bankruptcy Chapter 13 bankruptcy is filed for an individual with a regular source of income to help reorganize debts, and make payments to a trustee, who will then pay creditors.

What to Expect Prior to filing for bankruptcy, you must obtain a certificate of credit counseling from an approved credit counseling provider. Bankruptcy law requires you to file a bankruptcy petition, which contains schedules listing debts, assets, expenses, and income. An individual is assigned to administer your case, and this person is called a trustee.

Meeting of Creditors About a month after the bankruptcy petition is filed, there is a meeting of creditors where the trustee reviews your case and asks basic questions regarding your petition.
